MOVE Act Waivers
New federal law (The Military and Overseas Voter Empowerment Act (MOVE Act) requires ballots for uniformed services and overseas citizen voters be sent at least 45 days prior to a general election for Federal office, starting with this November’s general election. The 45 day prior deadline this year is September 18, 2010. Under the MOVE Act, States were allowed, under certain circumstances, to apply for a waiver from the 45 day prior requirement.
For this November’s election, the Department of Defense received applications from 10 States, the District of Columbia, and the territory of the U.S. Virgin Islands. Through the individual State links below, each State’s waiver application, supplemental application materials, and the Department of Defense’s responses are posted.
A detailed explanation of the process the Department used in making these decisions, as well as the particular explanation for each State, is provided in the Department’s response posted on each State's page.
